Terms of Service — WholeBikes

1. Acceptance of Terms

By accessing or purchasing from wholebikes.com (the "Site"), operated by QHQO Inc, doing business as WholeBikes ("WholeBikes," "we," "us"), you agree to these Terms of Service. If you don't agree, please don't use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. E-bikes are subject to local age, licensing, and helmet laws for riders — you are responsible for knowing and following the laws in your area.

3. Products and Pricing

We strive for accurate product descriptions, images, and pricing, but errors can occur. We reserve the right to correct pricing or availability errors, cancel orders affected by such errors, and refund any payment already made. Prices are in USD and subject to change without notice; the price at the time of order confirmation applies to that order.

4. Orders and Payment

Placing an order is an offer to purchase, which we may accept or decline — for example, for suspected fraud, pricing errors, or inventory issues. Payment is processed at checkout via our payment providers; we do not store full payment card details.

5. Shipping

Shipping timelines and costs are shown at checkout. Ownership and risk of loss transfer to you upon delivery to the carrier. Delivery estimates are not guaranteed. See our Shipping Policy for details.

6. Returns and Refunds

Returns are governed by our Return & Refund Policy, incorporated into these Terms by reference.

7. Assembly and Safety

WholeBikes e-bikes ship unassembled and require full self-assembly before use, following the included instructions. We strongly recommend having your bike assembled or inspected by a qualified bicycle mechanic before your first ride. You are responsible for:

• Following the included assembly and safety instructions
• Wearing a helmet and following local traffic and e-bike classification laws
• Regular maintenance — brakes, tires, and battery care — per the included manual
• Not exceeding the stated weight limit or using the bike for purposes it wasn't designed for

WholeBikes is not liable for injury or damage resulting from improper assembly, failure to follow safety instructions, or use inconsistent with the product manual.

8. Warranty and Disclaimers

Products are covered by the warranty described in our Return & Refund Policy. Except for that express warranty, products are provided "as is" to the maximum extent permitted by law. We disclaim implied warranties of merchantability and fitness for a particular purpose where legally permissible.

9. Limitation of Liability

To the maximum extent permitted by law, QHQO Inc is not liable for indirect, incidental, special, or consequential damages arising from use of our products or Site. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

10. Intellectual Property

WholeBikes® and all associated logos are trademarks of QHQO Inc. All content on the Site — text, images, logos, and product designs — is owned by or licensed to QHQO Inc and may not be used without permission.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Los Angeles County, California, unless applicable consumer protection law requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance.
